Government of Alberta Amends EPR Regulation
On Wednesday, March 26, 2025, the Government of Alberta amended the Extended Producer Responsibility (EPR) Regulation in two ways.
The amendments are in the following documents:
- Order in Council 069/2025:
Amendment to Section 13:
(a) in subsection (1) by striking out “Single-use products” and substituting “Subject to subsection (1.1), single-use products”;
(b) by adding the following after subsection (1): (1.1) This Part does not apply to a packaging-like product made wholly of flexible plastic or that portion of a packaging-like product made of flexible plastic.
- Order in Council 070/2025:
The Administrative Penalty Regulation (AR 23/2003) is amended by this Regulation and comes into force on April 1, 2026.
What This Means:
Packaging-like products, made wholly or partially of flexible plastic, are no longer regulated materials, and will not be a part of the PRO’s collection requirements. This impacts products like Ziploc bags, garbage bags, and cling wrap.
The RCA is actively working on a more detailed response to these changes.
